What is an electronic signature?

An electronic signature is a digital indication of a person’s intent to agree to the content of a document or a set of data to which the signature relates. Like its handwritten counterpart in the offline world, an electronic signature is a legal concept capturing the signatory's intent to be bound by the terms of the signed document.

  • They are uniquely linked to and capable of identifying the signatory;
  • They are created in a way that allows the signatory to retain control
  • They are linked to the document in a way that any subsequent change of the data is detectable

How do electronic signatures work?

Providers such as E-Sign associate a signer with a document in a recorded transaction via a coded message through specific PKI protocols. The PKI protocols require the provider to use a mathematical algorithm that generates a public and private key for each document transaction.

When a person e-signs a document, the signature is created using the signer’s private key, which is always securely restored by the signer. The mathematical algorithm used by E-Sign acts like a cipher, creating data matching the signed document, called a hash, and encrypting that data as an advanced electronic signature.

When a document is sent via E-Sign the signer uses the public key to decrypt the signature via cypher. If the hash values are equal, then the signature is valid.
